These Terms & Conditions (the “Terms”) govern the arrangement and provision of chauffeured
ground-transportation services by 14237935 Canada Inc., operating as Canada Limo & Niagara Falls
Tours (“Canada Limo,” “we,” “us,” or “our”), and your use of our website and reservation services. By
requesting a quote, making a reservation, or riding with us, you (“you,” the “Client,” or the “Passenger”)
acknowledge that you have read, understood, and agree to be bound by these Terms.
All rates quoted for our services are estimates only. Final charges are based on the actual service
provided and confirmed on completion of the trip. Additional charges may apply, including but not limited to:
We are transparent about our pricing: you are only charged fees that have been communicated to you. Any extra
service used on the day is billed at our standard rate as used, and we let you know first wherever practical.
A reservation is confirmed only once you have accepted the quoted rate and received a written Booking
Confirmation from us by email. Please review your Booking Confirmation carefully and notify us immediately of any
error in the trip details. For booking changes and cancellations, reply to your confirmation email or call us.
After we confirm your rate, you will receive a secure payment authorization link from our certified payment
processor. We never ask for card numbers on our website forms. Applicable Harmonized Sales Tax (HST) and
gratuity are shown on your quote. Additional charges incurred during the trip (for example, a Highway 407 toll,
extra waiting time, or extra hours) are billed after the trip to the card on file or as otherwise arranged.
To cancel, reply to your Booking Confirmation email or call 1-855-370-3001.
The cancellation time is the time we receive your notice.
Refunds may only be considered in exceptional circumstances, solely at the discretion of Canada Limo management,
and on a case-by-case basis. By engaging our transportation services, you acknowledge and agree to this No-Refund
Policy.
We endeavour to maintain the schedule submitted by our Clients, but timely arrival is not guaranteed. We are not
responsible for delays or missed connections caused by circumstances beyond our reasonable control (see Section 9).
For airport pickups, complimentary wait time is provided as communicated at the time of booking; waiting time
beyond the included grace period is charged at our standard rate.
Canada Limo arranges chauffeured transportation that may be performed either by our own chauffeurs or by
independent third-party operators and chauffeurs (each an “Operator”) engaged as independent contractors.
Operators are not employees, partners, or agents of Canada Limo, and no employment, agency, or joint-venture
relationship is created between Canada Limo and any Operator.
Each Operator is separately licensed and is required to hold, and by accepting a trip represents and warrants
that they hold, at all times valid and in force:
Onboarding & good-faith reliance. Every Operator must submit their credentials and documentation
through our onboarding process (via our application or by email) and be registered with us before receiving any
trip. We do not assign a trip to any Operator who is not properly registered and documented with us. Canada Limo
reviews the documentation provided and relies on it in good faith; however, Canada Limo is not the issuer of, and
does not and cannot independently guarantee the ongoing validity, authenticity, or renewal of, licences, permits, or
insurance issued by third parties or government authorities.
Operator responsibility. By accepting a trip, the Operator confirms that all required licences, permits,
and insurance are valid and in force at the time of pickup and throughout the trip. An Operator who accepts a trip
without current, valid documentation does so in breach of their agreement with Canada Limo and assumes sole and
full responsibility for any resulting consequences. Each Operator has been informed of, and has agreed in
writing to, these responsibilities as a condition of working with us.
No reassignment. The assigned Operator must personally perform the trip and may not transfer,
sublet, broker, or reassign it to any other person or company. Any unauthorized reassignment is performed entirely
outside the authority of Canada Limo and is the sole responsibility of the Operator who made it.
Allocation of responsibility. To the maximum extent permitted by applicable law, the Operator — and not
Canada Limo — is solely responsible for the safe operation of the vehicle, the manner in which the trip is
performed, and any act, omission, negligence, accident, injury, delay, loss, or damage arising from the Operator’s
conduct or from the Operator’s failure to hold valid and current credentials or insurance.
To the maximum extent permitted by applicable law, Canada Limo is not liable for any delay, service interruption,
loss, injury, or damage caused by acts of God, severe or winter weather, hazardous road conditions, traffic,
strikes, riots, civil unrest, authorities of law, public enemies, a state of war, quarantine, perils of navigation,
mechanical failure or breakdown, accidents, or any other condition beyond our reasonable control, or arising from
the acts or omissions of an independent Operator (see Section 7).
To the maximum extent permitted by law, Canada Limo’s total aggregate liability arising out of or relating to any
booking is limited to the amount actually paid by the Client for that booking. Canada Limo is not liable for any
indirect, incidental, special, consequential, or punitive damages, including lost profits, missed flights or
connections, or lost business opportunities. Nothing in these Terms excludes or limits any liability that cannot be
excluded or limited under applicable law.
You agree to indemnify and hold harmless Canada Limo, its directors, officers, and employees from and against any
claims, losses, damages, liabilities, and reasonable legal costs arising from your breach of these Terms, your
misuse of a vehicle, or the conduct of any member of your party. As between Canada Limo and an Operator, the
Operator is responsible for indemnifying Canada Limo in respect of claims arising from the Operator’s own acts,
omissions, negligence, or failure to maintain valid credentials or insurance.
We respect the privacy of every Passenger, including corporate, VIP, and high-profile clients. Chauffeurs and
Operators are instructed not to photograph, record, publicize, or disclose the identity, itinerary, or movements of
any Passenger, and to treat all trip information as confidential. Personal information is handled in accordance with
our Privacy Policy.
Please check that you have all belongings before leaving the vehicle. While we will make reasonable efforts to
return items reported lost, Canada Limo and its Operators are not responsible for property left in a vehicle and do
not guarantee its recovery, safe-keeping, or return.
Every vehicle in our fleet is a smoke-free, vape-free, and cannabis-free environment. This applies to tobacco and
e-cigarettes/vaping devices, to cannabis (marijuana) in any form — whether smoked, vaped, or otherwise consumed —
and to any other controlled, restricted, or illegal substance.
This policy reflects, and is required by, Canadian and Ontario law. Smoking or vaping tobacco or cannabis in a
vehicle used in the course of work is prohibited under Ontario’s Smoke-Free Ontario Act, 2017, and consuming
cannabis in a motor vehicle is prohibited under the federal Cannabis Act and Ontario’s
Cannabis Control Act, 2017 and Highway Traffic Act. You can review Ontario’s rules on cannabis and
smoking at ontario.ca/page/cannabis-laws.
Both the passenger and the Operator are bound by this policy at all times. If any passenger or Operator
smokes, vapes, or consumes cannabis or other drugs in a vehicle, they do so in violation of this policy and of the
law, and they alone — not Canada Limo — bear full legal and financial responsibility for their conduct.
To the maximum extent permitted by law, Canada Limo is not liable for any accident, injury, loss, damage,
fine, penalty, or legal action arising from or connected to smoking, vaping, cannabis, or drug use in a vehicle,
whether by a passenger or by an Operator, during a ride or in any other circumstance. Responsibility rests solely
with the person who breached this policy.
The chauffeur may refuse to begin, or may immediately terminate, service without refund if smoking, vaping, or
cannabis or drug use occurs. A cleaning fee of not less than $200 (Section 8) will apply, and the Client
remains responsible for any further damage.
Passengers must comply with all applicable laws while in a vehicle. Alcohol consumption is permitted only where
lawful and only by passengers of legal drinking age; the Client is responsible for ensuring compliance. Seat belts
must be worn where fitted. Illegal activity of any kind is strictly prohibited and may result in immediate
termination of service without refund and referral to the authorities.
Canada Limo and its Operators maintain the insurance required by applicable law for licensed
ground-transportation services in Ontario. Each Operator is responsible for maintaining their own current
commercial automobile insurance as described in Section 7.
Any invoice not paid within thirty (30) days of billing is subject to an interest charge at the maximum rate
permitted by law. In the event of non-payment or partial payment, Canada Limo may use any and all lawful means of
collection and is entitled to recover all reasonable legal fees and costs incurred in its collection efforts.
These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal
laws of Canada applicable therein. Any dispute shall be subject to the exclusive jurisdiction of the courts of
Ontario, and you consent to that jurisdiction and venue.
These Terms, together with your Booking Confirmation, constitute the entire agreement between you and Canada Limo
regarding your booking and supersede any prior understanding. If any provision is found unenforceable, the remaining
provisions continue in full force. Our failure to enforce any provision is not a waiver of it. You may not assign
your booking without our consent; we may assign or delegate performance (including to an Operator) as described in
these Terms.
We may update these Terms from time to time. The version posted on this page is the version in effect. Your
continued use of our services after any update constitutes acceptance of the revised Terms.
